How to Register Trade Union

A trade union is a combination of workmen or employers with the primary purpose of regulating the relations between workmen and workmen or between employers and employers or to impose restrictive conditions on the conduct of any trade or business. Besides the primary objects, the rule of a trade union may contain civil, education, social and cultural objects which are not inconsistent with the primary objects or opposed to any law.

To achieve the goal of collective bargaining, the law extends due recognition to the right of association and seeks to faster a healthy and responsible trade union movement. It provides from a compulsory recognition of trade unions by the employers reduces the possibility of favour being shown to Pocket Union.

It stipulates how can trade union achieve the goal. If there is one trade union it provides that it will represent the employees as collectives bargaining agent. If there are more than one trade union, the law provides from a referendum so that the winning trade union would become entitled by law to represent the employees as collectives bargaining agent.

The ordinance permits both the workers and employers to establish and to join associations of their own choosing without any previous authorization.

Trade unions have the right to draw up their constitutions and rules, to elect their representative in full freedom, to organize their administration and activities and to formulate their programmers.
Registration of Trade Union:

Any trade union may, under the signature of its President and the Secretary, apply from registration of the trade union under section 5 of Industrial Relations ordinance, 1969.

Requirements for application for Trade Union Registration

Every application for registration of trade union shall be submitted to the Registrar. It should be accompanied by the following under section 6:-
  • The name of the trade union.
  • The address and location of its head office.
  • The date of formation of the union.
  • The names, ages, addresses, titles and occupations of the officers of the trade union.
  • The statement of total paid membership.
  • In case of federation of trade unions, the names, addresses and registration number of member unions.
  • Three copies of the constitution of the trade union together with a copy of the resolution by the members of the trade union adopting such constitution bearing the signature of the Chairman of the meeting.
  • A copy of the resolution by the members of the trade union authorizing its President and the Secretary to apply for its registration! and
  • In case of federation of trade unions, a copy of the resolution from each of the constituent unions agreeing to become a member of the federation.

Requirements For Registration of Trade Union

A trade union has to provide the following information’s form its registration under section 7:-
  • The name and address of the trade union.
  • The objects for which the trade unions has been formed.
  • The purposes for which the general funds of the unions shall be applicable.
  • The number of persons forming the executive which shall not exceed the prescribed limit and shall include not less than seventy – five percent from amongst the workmen actually engaged or employed in the establishment or establishments or the industry for which the trade union has been formed.
  • The conditions under which a member shall be entitled to any benefit assured by the constitution of the trade union and under which any fine or forfeiture may be imposed to him.
  • The maintenance of a list of the members of the trade union and of adequate facilities for the inspection, thereof by the officers and members of the trade union.
  • The manner in which the constitution shall be amended, varied or rescinded.
  • The safe custody of the funds of the trade union, its annual audit, the manner of audit and adequate facilities for inspection of the account books by the officer and members of trade union.
  • The manner in which the trade union may be dissolved.
  • The manner of election of officers by the general body of the trade union and the term, not exceeding two years, for which an officer may hold office upon his election or re-election.
  • The procedure for expressing want of confidence in any officer of the trade union and
  • The meetings of the executive of the general body of the trade union, so that the executive shall meet at  least once every year.

Certificate of Registration

The Registrar, on being satisfied that the trade union has complied with all the requirements of this ordinance, shall register the trade union in a prescribed register and issue a certificate of registration in the printed from which shall be conclusive evidence that the trade union has been duly registered under section 8.


Maintenance of Record



Every registered trade union shall maintain a record in a particular register showing subscription paid by each member, an accounts book showing receipt and expenditure and a minute book for recording the proceedings of meeting.
